A Typical Lease Agreement Nightmare

Patti bought a generic lease agree from an office supply store. It covers the basics: when rent is due, late fees and when the lease ends. Unfortunately for Patti, the generic lease did not cover 4 vital issues that created a nightmare.

Issue 1
Patti’s tenant Rochelle decided that her boyfriend Chris should move in her. Rochelle did not feel she needed to inform Patti because the lease did not mention anything about guest staying in the rental with her. Patti did not find not about Chris until too late.

Chris moved in and brought his two cats and 75lbs dog. Chris and Rochelle were irresponsible with their pets. The cats used the carpet as a litter box and the dog dug holes all over the yard. He also barked constantly at the neighbor’s children.

Rochelle liked Chris’s waterbed, so he set it up in the upstairs bedroom. Chris and Rochelle both worked and left the pets unattended during the day. On a Thursday, they left the backdoor slightly ajar. The dog came in the house and chased the cats throughout. Sadly, the tan cat jumped on the waterbed and the dog followed. This chase resulted in a punctured waterbed.
When Chris and Rochelle returned home, they found the front room’s drywall sagging to the carpet and 2 inches of water throughout the house. Rochelle immediately called Patti and told her she needed to come fix the damaged ceiling and the carpets.
Patti was shocked when she arrived at her rental unit. Rochelle greeted her and demanded the damages be repair or she was moving out because the house was unlivable. Patti could not believe what she heard.
Issue 4
Then the blame game started. Patti told her, Chris, the cats and the dogs were not part of the lease agreement. Waterbeds were not allowed in the rental. Patti added Rochelle should have the common sense to have renters insurance. Rochelle found a copy of the lease and showed Patti that none of these issues were covered in the lease agreement.
Who lost?
Patti did.
Her lease stated nothing about the length of time a guest could stay in the rental. There were no references to pets, waterbeds or renters insurance. Patti called her insurance company to start the claim process. It took two weeks for a restoration company to make the repairs and clean up her rental.

Hello, i guess this is as good of a place as any to post and let you know. I went to subscribe to your RSS feed, and when i clicked it i got an error that said “Parse error: syntax error, unexpected T_CONSTANT_ENCAPSED_STRING” followed by other gibberish that scrolled off the screen. I had to force the page to stop loading because it locked up my browser. Cheers, Mick.
