Evicting a tenant is always the last step. Don't be afraid to evict someone, just evict after you exhaust all other means. Evictions can be costly and stressful.
First, try to negotiate with the tenant and make payment arrangement.
Second, estimate what an eviction will cost you. Lost rent, filing fees and possible attorney fees.
Some landlord will actually pay a bad tenant to move out. This may sound backwards, but sometimes it is extremely effective. Let's say you do the math and an eviction will cost you $1,500. If the tenant owes you $1,000 and you pay him $500 to move out by a certain date - you break even. You save a lot of stress. Determine what your time and stress levels are before you make this decision.
You can evict a tenant on your own. This will save you money but cost you time. If you choose the evict on your own, Renting Authority has a the eviction forms you need.
