what are the liabilities if we need to break a 1 yr lease  due to financial reasons? we r the landlord .

Teddi, that is a great question.  You should check with your local housing authority or a real estate attorney regarding the laws in your area.  I have spoken with several landlords who have terminted the lease early.  Most of them have not had problems because they communicated early on with the tennant what their intentions were. Some have even helped the tenants find new housing.  I hope this is helpful.

My tenant contacted me today to inform me that he wants to break the lease do to relocation.  I used your template, but there is nothing indicated about breaking the lease.  Can I hold them to it or do I have to allow them to break it?

Legally, the tenant who signed the lease is responsible to fulfill the terms of thelease.  If you let them out the lease, that is your option.  You need to decide, is it worth your time and effort to pursue this legally.  If yes, stick to the lease, make the tenant pay the balance of the lease or find someone you approve of to take over the lease.

If you lease a car, and decide you don't like it anymore, you still are obligated to pay the lease payments.  The same thing applies in rental lease agreements.

in the real world trying to hold a tenant to a lease (make them stay or payout the lease) is a waste of effort you will never collect the money but will be out of pocket the cost of trying to get the judgement even if you get the judgement you are unlikley to ever collect on it

spend the time and money looking for the next tenant (at a higher rent if you are under rent control)
