I assist the landlord at the apartment building I live in.
We have a situation with a tenant that he rented to back in July 2008. The apartment was supposed to be for 1 female and her 3 yr.old daughter.
The woman paid 1 month's rent at that time and never paid rent again. She's been living in the apartment since October as the apartment went through some renovations.
She moved in and so did her boyfriend who is not our tenant, he never signed a lease or gave any money to the landlord.
They took landlord to court saying apt. needed work, which in reality it didn't. The court ordered landlord to make any asked for repairs. I found out that they were little things like a crooked toilet seat or the kitchen floor was dirty. Crazy little things like that.
Now when the landlord knocked on the door to make any ajustments that they asked for, getting no response the landlord used his passkey and the boyfriend who would not allow the landlord to enter the apartment attacked the landlord with a meat cleaver. Fortunately he missed and hit the wall. The police were called and arrested the boyfriend who babysits his daughter who was supposed to be in daycare. We issued boyfriend a NO-Trespass order and he has violated it twice. Police escorted him out of the building with his daughter yesterday.
Court date is coming up in February and wouldn't you think the landlord should have no problem evicting these people. Her rent is in arrears to the tune of $7,000. Plus the landlord was attacked with a deadly weapon that the police officer had in his hand on exiting the building.
Do you think the court will be in the landlord's favor and allow the evicition?? If I owned this building they would have already been long gone.
Thanks for any feedback. This is bothering me!! If the court doesn't allow the evicition I plan on talking to the Judge myself as I was witness hearing the incident with the meat cleaver but not near the apartment it was down the hall from me. This was the most quiet building on the planet til these creatures moved in.
