Please read this.  I never want this to happen to you.
Take this short illegal discrimination quiz.  See if you are inadvertently discriminating.
Have you ever done the following?

  1. Told an applicant there is not an opening because you did not want to rent to that person, when there really is an opening.
  2. Advertised in such a manner that indicates a preference base on group characteristics, such as skin color or sex.
  3. Set restrictive standards for certain applicants and not others, such as higher income.
  4. Refusing to reasonably accommodate the needs of disabled clients, such as hearing dog, sight dog, or other service animals
  5. Had different sets of late payment penalties for different tenants.

The Fair Housing Acts prohibit landlords from taking any of the above actions based on race, religion, or any other protected category.

That was a good article,  How about though, where a property manager offers discounts.  Example:  Gross rent is 1000.00 per month, but discounts are offered for good credit, above average pay history with prior landlord, discounts for number of occupants.  Example:
 
Gross rent:   1,000,00
Ref Discount   -100.00
2 Occupants   -100.00
Non Smoker   - 100.00
Net after disc 700.00.
 
I would be discriminating based on the anticipated risk of the client.  Would that work?  Thanks,  Bob

Bob, your discounts do not discriminate.  You must have the discounts written out and present them to everyone who applies in advance. Make sure that every application knows the discounts.  Credit and smoking are not protected classes.

Steve, age is not a protected class.  You can have housing for certain age groups.  If you do, then you must follow your own rules strictly.
 
Title VI prohibits discrimination on the basis of race, color, or national origin in programs and activities receiving federal financial assistance.

THe Age Discrimination Act of 1975  is designed for properties receiving Federal financial assitance.  http://www.dol.gov/oasam/regs/statutes/age_act.htm
