Hi Troy, we have been saving all your excellent rental information for months now. My tenants just called me and said they were moving out on the 1st!!!!! They have a lease signed with us until the end of June.
They said they dont care, their credit is ruined anyway because their car was just repo'd. My question is, if we take them to court for the lease, can we attach his wages? we know he wont pay, were keeping his deposit to pay for the month and he wants to just walk away and leave me with a nervous breakdown.
He stills owes $133.00 for last month and thinks he's doing me a great favor leaving the place in good condition to have somebody move in right away. Anyhow, could you give me any legal advise on this? I will never trust anybody again!!!!! except you of course. Thanks, hope to hear from you soon.

Laura,
I am sorry to hear of your predicament. Yes, take your tenant to small claims court. If the judge rules in your favor, you can have wages deducted from his pay. Keep this in mind. It may cost you around $500 for court filing fees plus your time and effort. Weight this against the time and effort it will take to find a better tenant.
